Estate planning is often considered as expensive, complex and miserable. People may have the misconception that only the wealthiest people need a Will, but in fact, each and everyone of us owns assets, be it your bank account or MPF, which would need to be dealt with by your loved ones if you pass away. In other words, each and every one of us is entitled to and in fact, should put in place a Will.

 

Hence, we created InstaWill, which allows you to put together a simple Will easily at home or on the go, without the need to meet a Will writer in person, particularly during the pandemic where all of us are reducing physical contacts.  

 

There are certain criteria listed below in order to use InstaWill, depending on the complexity of the Will. When it is acceptable to create your own Will through InstaWill?

  • You are at least 18 years old

  • You live in Hong Kong and this is a Hong Kong Will

  • Your assets are located in Hong Kong only

  • You are appointing one Executor and one back up Executor

  • You don’t have minor children (i.e. any child younger than 18 years old)

  • For married couple Beneficiaries – You wish to leave everything to your husband or wife, and if they die before you, you want to leave everything to your adult children or up to five adults (if no children)

  • For single person Beneficiaries – You wish to leave everything to up to five adults

Basically, if you are in a situation that is more complicated than the above, including but not limited to:

  • You are appointing more than two Executors

Commonly used terms in Will

Executors

  • They are the persons who administer your estate if you pass away

  • They can be your family members or friends, most importantly, someone you trust

  • They must be at least 21 years old

  • With InstaWill, you have an option to appoint 1 x first choice executor and 1 x back up executor

  • You do not need their formal approval, but it is always a good idea to speak with them and get their permission first

  • For your Will, you will need their (1) full name in English and Chinese, (2) HKID number and (3) date of birth

 

Beneficiaries

  • They are the persons who will receive your estate if you pass away

  • They are usually your family members

  • With InstaWill, you have an option to choose up to 5 beneficiaries for single persons

  • For your Will, you will need their full name in English and Chinese
